Data sharing agreement

1. Parties & purpose

This Data Sharing Agreement (“Agreement”) is between [COMPANY LEGAL NAME] (“Warrantiva”) and the manufacturer or distributor named in the approved partner application (“Partner,” “you”). It covers what program data each party shares, how it may be used, and how homeowner information is protected. The Terms of use also apply to your use of the platform.

2. What Warrantiva shares

Warrantiva provides you with reports on how the labor coverage program is working for your products and dealers, such as:

• Registration summaries: units registered, terms chosen and parts upgrades, by month;
• Claims and failure trends: labor claims by part and model;
• Dealer activity: warranties per dealer, program tier status and growth;
• Registration turnaround: how quickly registrations are completed after installation.

Reports describe equipment and dealers. They don’t include homeowner names or contact details unless Section 5 allows it.

3. What you share with Warrantiva

• Your product data, such as models and model numbers covered by your warranty programs;
• Your dealer list and each dealer’s tier in your dealer program, so Warrantiva can verify the tiers dealers report;
• Your current warranty program terms, which you keep up to date in the partner portal.

You confirm you have the right to share this information with Warrantiva for these purposes.

4. How shared data may be used

• You may use Warrantiva’s reports to run and improve your products, warranty programs and dealer programs. You may not resell them or use them to solicit homeowners.
• Warrantiva uses your data to operate the program: verifying equipment and dealer tiers, pricing coverage, and reviewing claims.
• Neither party will share the other’s data with third parties except service providers bound by confidentiality, or as required by law.

5. Homeowner information

Homeowner information is handled under Warrantiva’s Privacy policy. Warrantiva shares a homeowner’s details with you only when needed to verify a registration or process a manufacturer warranty claim on that homeowner’s equipment, and you will use them only for that purpose.

6. Security & incidents

Each party will protect shared data with reasonable administrative, technical and physical safeguards, and will notify the other within [NOTIFICATION PERIOD] of discovering unauthorized access to shared data.

7. No fees

There are no fees or payments under this Agreement. Warrantiva does not bill manufacturers or distributors.

8. Term & ending

This Agreement starts when your partner application is approved and continues until either party ends it with [NOTICE PERIOD] written notice. When it ends, each party will stop using the other’s data except as required by law or to support warranties already registered.

9. General terms

Warrantiva may update this Agreement with [NOTICE PERIOD] notice. This Agreement is governed by the laws of [STATE]. The person accepting it confirms they are authorized to do so on behalf of the company named in the partner application.
